(1) If there is a statement of the defendant, the case shall be disposed of within ninety days from the date of the statement, and if there is no statement of the defendant, including the payment date.
(2) Regardless of what is written in sub-rule (1), if the court has already reached the end of the case before that time, the case must be decided within three days from that date.
